Terms of Use

These Terms of Use (hereinafter: "Terms") govern the use of the OUT CITY website (hereinafter: "Website"), developed and maintained by Pontus Campus d.o.o., with its registered office at Ilica 16, 10000 Zagreb, Croatia, OIB: 30467510659, registered in Croatia (hereinafter: "we," "us," or "Company"). The Website enables users to view events, reserve tables, purchase subscriptions with benefits, buy tickets for specific events, and read news such as new menus, operating hours of bars and nightclubs at the same address, and similar information. These Terms are compliant with the Hospitality Industry Act of the Republic of Croatia (NN 138/06 and subsequent amendments), the General Data Protection Regulation (GDPR - Regulation (EU) 2016/679), the Personal Data Protection Act of the Republic of Croatia, and other relevant EU and Croatian laws.

By using the Website, the user (hereinafter: "you" or "User") accepts these Terms in their entirety. If you do not accept the Terms, do not use the Website. We reserve the right to amend the Terms at any time, and the amended Terms will be published on the Website. Continued use of the Website after the publication of changes constitutes acceptance of those changes.

1. Age Restriction

The Website is intended solely for persons over 18 years of age, in accordance with the Hospitality Industry Act of the Republic of Croatia and laws protecting minors. Users must be at least 18 years old to register and use the Website. During registration, the User confirms they are at least 18 years old. We may request proof of age at any time. If we determine that a User is under 18, their account will be suspended or deleted without notice.

2. Description of Services

The Website enables:

Viewing events at bars and nightclubs at the same address.
Table reservations.
Purchasing subscriptions with benefits (e.g., discounts, priority access).
Purchasing tickets for specific events.
Reading news such as new menus, operating hours, and similar announcements.

The services are accessible via desktop and mobile devices and are subject to availability. We do not guarantee uninterrupted access or the accuracy of information. Reservations and purchases are final and subject to the rules of the hospitality venues.

3. User Accounts

To use certain features (e.g., reservations, purchases), account registration is required. The User is responsible for the accuracy of provided information and the security of their password. We are not responsible for unauthorized access to the account. The User agrees not to share their account with others.

4. Purchases and Payments

Purchases of subscriptions, tickets, and reservations are made through integrated payment systems. Prices are listed in the Application and include VAT in accordance with Croatian laws. Payments are secure and compliant with EU standards (e.g., PSD2). Refunds are possible only in accordance with the Consumer Protection Act of the Republic of Croatia (NN 41/14 and subsequent amendments). We are not responsible for payment errors caused by the User.

5. Intellectual Property Rights

All content on the Website (texts, images, design) is the property of the Company or licensed. The User is granted a limited, non-exclusive license to use the Website for personal purposes. Copying, distribution, or commercial use without our written permission is prohibited.

6. User Conduct

The User agrees to:

Not violate the laws of the Republic of Croatia and the EU.
Not use the Website for illegal activities (e.g., false reservations).
Not post offensive content. Violations may result in account suspension.

7. Limitation of Liability

We are not liable for damages caused by the use of the Website, except in cases of intentional or gross negligence, in accordance with the Obligations Act of the Republic of Croatia. We do not guarantee the accuracy of event information or the availability of services at hospitality venues.

8. Termination of Use

We may terminate access to the Website at any time without notice, particularly in cases of violation of the Terms. Additionally, membership or use of the Website does not guarantee entry or stay in our premises, especially in cases of inappropriate behavior or failure to comply with requests/orders from our staff or security personnel.

9. Applicable Law

These Terms are subject to the laws of the Republic of Croatia and the EU. The competent court is in Zagreb. In case of disputes, the User may file a complaint with the Croatian Competition Agency or AZOP for data protection issues.

The Privacy Policy is part of the Terms and describes how we collect, use, and protect Users' personal data, in accordance with GDPR (Regulation (EU) 2016/679) and the Personal Data Protection Act of the Republic of Croatia.

10.1. Data Controller

The Company is the data controller. Contact: sold@out.city. AZOP is the competent authority for data protection in Croatia.

10.2. Collected Data

We collect:

Personal data: Name, email, phone number, date of birth (for age verification), address.
Usage data: IP address, location (if permitted), reservation and purchase history.
Payment data: Processed through third parties (e.g., payment processors); we do not store card numbers.

Data is collected based on your consent, contract (e.g., reservations), or legitimate interest (e.g., improving services).

10.3. Purpose of Processing

Providing services (reservations, purchases).
Sending event notifications (if subscribed).
Analyzing usage to improve the Website.
Legal obligations (e.g., tax reporting).

Consent is voluntary and can be withdrawn at any time via via the Application settings or by contacting us directly. You have the right to:

Access, correct, or delete data (right to be forgotten).
Restrict processing or object.
Data portability. Requests should be sent to sold@out.city. We respond within 30 days.

For minors: We do not collect data from persons under 18. If such data is detected, it is deleted.

Data is shared with:

Hospitality venues (for reservations).
Payment processors.
Legal advisors in case of disputes. We do not share data outside the EU/EEA without appropriate safeguards (e.g., standard contractual clauses).

10.6. Security and Storage

Data is stored securely (encryption, access controls). It is retained as long as necessary (e.g., 5 years for tax purposes) and then deleted.

10.7. Cookies and Tracking

The Website uses cookies for functionality. Consent is requested upon first use.
